How do I receive a pre-filing diversion for a misdemeanor?
I was cited a few weeks ago with furnishing alcohol to a minor and the conviction will end my career. I learned that the DA might offer me a diversion to clear the charges once I have completed the program. Does anyone know how I can request it? The fee from the conviction is $1000 and a lawyer wants a retainer of like $2-3 thousand bucks. Can I get a diversion through self representation or should I hire the attorney.
You can get diversion without the attorney (who is charging way too much). Go to the prosecutor's office and ask. They will have to run a check to see if you are eligible. It shouldn't be a problem. If the prosecutor says no, you can always hire the lawyer at that point. Also, to find another attorney, check out your state's bar association website.
