How do I get my vehicle back if I am the title holder and the current driver will not relinquish it?

How do I get my vehicle back if I am the title holder and the current driver (not an owner) will not relinquish it back to me? I sent a certified letter the the current driver and the refused to give the vehicle back. They state because they have paid the insurance they have a legal stake in the vehicle. Can I go to the police department and report the vehicle stolen? I am in Tucson, AZ Thanks everyone for any help you can give me.

In order to get your car back you can do a few things; however, an important question is how did the person get the car in the first place? Did you buy the car or give the car to somebody for their permanent use and now are trying to take it back? If so, even if you have the person arrested they will get out and probably sue you. If you just let them borrow the car for a limited time and they are now trying to keep the car permanently then yes you can have them arrested. Your second choice is to sue them in small claims court for the car or the value of the car. You have already put them on notice of your claim to recover the vehicle with the certified letter. Keep in mind you can also add in court cost and reasonable attorney fees. Your third option is to request the police assist you in the car recovery by accompanying you to the house to pick up the car. As long as you have title in hand and explain ALL the details to them they will probably assist you.
